Terms of Service

By using the SynAck("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service"). All access and use of the Service is subject to the terms and conditions contained in these Terms of Service (as amended from time to time). By accessing, browsing, or otherwise using the Site, Mobile Apps, API, or any other aspect of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not accept the terms and conditions of these Terms of Service, you will not access, browse, or otherwise use the Service. Violation of any of the terms below may result in the termination of your Account.

Account Terms

  1. You must be at least of "Minimum Age" to use this Service. Minimum Age means 16 years old. However, if law requires that you must be older for us to lawfully provide the Services to you without parental consent then the Minimum Age is such older age.
  2. You must be a human. Accounts registered by "bots" or other automated methods are not permitted.
  3. You must provide a valid email address and/or your username in order to complete the signup process.
  4. Your login may only be used by one person. A single login shared by multiple people is not permitted. You may create separate logins.
  5. You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  6. You are responsible for all content posted and activity that occurs under your account (even when content is posted by others who have accounts under your account).
  7. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction.

API Terms

Any access of the Service via API is governed by these Terms of Service plus the following specific terms:
  1. Abuse or excessive requests may result in the temporary or permanent suspension of your account's access to the API.
  2. We reserve the right at any time to modify or discontinue, your access to the API with or without notice.

Payment

  1. All paid plans must enter a valid credit card. Free accounts are not required to provide a credit card number.
  2. An upgrade from the free plan to any paying plan will immediately bill you.
  3. The Service is billed in advance on a monthly or annual basis and is non-refundable.
  4. All fees are exclusive of all taxes and/or levies imposed by taxing authorities, you shall be responsible for payment of all such taxes and/or levies.
  5. Downgrading your Service may cause the loss of features or capacity of your Account.

Termination

SynAck, in its sole discretion, may suspend or terminate your account (or any part thereof) or use of the Service and remove and discard any content within the Service, for any reason, including for lack of use or if SynAck believes that you have violated or acted inconsistently with the letter or spirit of these Terms of Service.

Copyright

  1. We claim no intellectual property rights over the material you provide to the Service. If you set any of your items to be viewed publicly, you agree to allow others to view and/or download your items.
  2. To the extent permitted under applicable law, you agree to defend, indemnify, and hold harmless SynAck, its affiliates, and its and their respective officers, employees, directors, service providers, licensors, and agents from any and all losses, damages, expenses, including lawyers' fees, rights, claims, actions of any kind, and injury arising out of or relating to your use of the Service, any User Content, your connection to the Service, your violation of these Terms of Service, or your violation of any rights of another.

General

  1. Support is only available in English.
  2. You understand that SynAck uses third party partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
  3. We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.
  4. The failure of SynAck to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision.
